These Terms of Service govern your use of FuelTheFam ("the app," "the service") operated by Family Nutrition Dashboard ("we," "us," "our"). By creating an account or using the service you agree to these terms in full.

1. Acceptance of Terms

By accessing or using FuelTheFam, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the service. These terms apply to all visitors, users, and others who access the service.

2. Early Beta Service

Important — Beta Product Notice

FuelTheFam is currently in early beta. The service is provided for general wellness tracking purposes only. Features are actively being developed, data may contain errors or inaccuracies, and the service may be modified, interrupted, or discontinued at any time without prior notice.

You acknowledge that as a beta product, FuelTheFam may not perform as expected, may contain bugs, and that features or data may change. We are not liable for any loss or inconvenience resulting from beta-stage instability.

3. Eligibility

  • You must be at least 18 years old to create an account.
  • By registering, you confirm you have the legal capacity to enter into a binding agreement.
  • If you add profiles for minor family members, you confirm you are their parent or legal guardian and take full responsibility for their data.
  • Accounts may not be created by or on behalf of children under 13 as standalone users.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate information when creating your account and family profiles.
  • Notifying us immediately at familynutritiondashboard@zohomail.com if you suspect unauthorised access to your account.

5. Health & Medical Disclaimer

FuelTheFam is a general wellness and nutrition tracking tool. It is NOT a medical device, clinical tool, or substitute for professional medical advice.

Nutritional targets, gap analyses, grocery suggestions, and all other outputs generated by the app — including AI-generated content — are based on general population guidelines and estimates. They are not personalised medical advice and are not intended to diagnose, treat, cure, or prevent any health condition or disease.

Always consult a qualified healthcare provider, registered dietitian, or nutritionist before making significant dietary changes — especially for children, pregnant or breastfeeding individuals, people with chronic health conditions, or anyone with a history of disordered eating.

Calorie counting and macro tracking may not be appropriate for all individuals. If you or a family member has concerns about their relationship with food, body image, or eating behaviour, please seek support from a qualified professional.

We explicitly disclaim any liability for health outcomes, medical decisions, or dietary changes made based on information provided by FuelTheFam.

6. AI-Generated Content

FuelTheFam uses Anthropic's Claude AI for meal parsing, nutritional gap analysis, and grocery list generation. You acknowledge that:

  • AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation.
  • Calorie and macro estimates for AI-logged meals are approximations and may vary significantly from actual values.
  • AI analysis does not account for individual health conditions, medications, allergies, or medical history.
  • You should verify AI-generated nutritional information against reliable sources before acting on it.

7. Acceptable Use

You agree not to use the service to:

  • Violate any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the app.
  • Use the service for commercial resale or sublicensing without written permission.
  • Upload or transmit malicious code, viruses, or harmful content.

8. Subscription Plans & Billing

FuelTheFam offers a Free plan and a Pro plan. Features available on each plan are described in the app and may change over time.

During the early beta period, Pro features may be made available to all users at no charge. This does not constitute a permanent entitlement — paid plans may be introduced at any time with reasonable prior notice.

When paid plans are introduced, billing will be handled securely through a third-party payment processor. Subscription fees are non-refundable except where required by applicable law.

9. Intellectual Property

The app, its design, features, and all underlying code are the intellectual property of Family Nutrition Dashboard. Nothing in these terms grants you any right to use our brand, logo, or content beyond what is necessary to use the service.

You retain ownership of all data you enter into the app — your food logs, family profiles, and personal information are yours. We claim no intellectual property rights over your content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, COMPLETE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAMILY NUTRITION DASHBOARD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of data, revenue, profits, goodwill, or health outcomes.
  • Damages arising from reliance on AI-generated nutritional information.
  • Damages arising from service interruptions, data loss, or security breaches beyond our reasonable control.
  • Medical decisions or dietary changes made based on information provided by the app.

Our total liability to you for any claim arising out of or related to these terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Family Nutrition Dashboard and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, if we believe you have violated these terms or are using the service in a manner that could cause harm to others or to us.

You may delete your account at any time by contacting us at familynutritiondashboard@zohomail.com. Upon deletion, your personal data will be permanently removed within 30 days.

14. Changes to These Terms

We may update these terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms. If you do not agree to updated terms, you must stop using the service.

15. Governing Law

These terms are governed by and construed in accordance with the laws of the State of New Hampshire, United States without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.
